Terms of Use
These Terms of Use (“Terms”) form a binding agreement between you and Ethos & Array (“we”, “us”, “our”) governing your use of ethosarray.com (the “Service”).
By using the Service you accept these Terms and our Privacy Policy. If you don’t agree, please don’t use the Service. These Terms are an electronic record under the Information Technology Act, 2000 and don’t require a physical or digital signature.
1. About the Service
Ethos & Array is an online discovery experience for fashion, home, and lifestyle goods. We help you find pieces from various brands and route you to their websites. We are not the seller — every purchase happens directly with the brand, under that brand’s own terms, prices, shipping, and return policies.
2. Your account
- You must be at least 18 to use the Service or create an account.
- Account information must be accurate and current.
- You are responsible for keeping your password secure. Tell us at hello@ethosarray.com if you suspect unauthorised access.
- You may close your account at any time by writing to hello@ethosarray.com.
3. AI-assisted recommendations
The Service uses AI to suggest pieces in response to your prompts. Recommendations are suggestions for inspiration, not professional advice. AI output can be inaccurate or out of date — always verify product details (price, sizing, availability, returns) on the brand’s website before buying.
Prices shown are converted using a recent exchange rate; the final charge is in the brand’s native currency and may differ.
4. Purchases happen on brand websites — not here
When you click an outbound link, you leave the Service and the brand’s terms apply. We do not handle payments, orders, shipping, returns, refunds, or customer support for those transactions. For any issue with an order placed on a brand’s site, contact that brand directly.
Affiliate relationships. We may earn a commission when you click through to a brand and complete a purchase. This does not affect the price you pay.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, fraudulent, or infringing purpose.
- Reverse engineer, scrape, or attempt to access the source code of the Service except as permitted by law.
- Interfere with the Service, attempt unauthorised access, or transmit malware.
- Impersonate another person or use someone else’s account.
- Upload personal data about another individual without their consent.
We may suspend or terminate your access if we reasonably believe you have breached these rules.
6. Your content
When you submit content to the Service (such as prompts and wishlist saves), you keep your rights and grant us a non-exclusive licence to host, store, and process it solely to operate and improve the Service for you. This licence ends when you delete the content or close your account.
7. Our intellectual property
Our intellectual property in the Service includes:
- The Ethos & Array name, wordmark, and logo — trademarks filed in India, not to be used without our consent.
- The source code and HTML — owned by us under copyright.
You may use the Service for personal, non-commercial purposes. All other rights are reserved. Brand names, logos, and product images of third-party brands belong to their respective owners.
8. Cookies and analytics
We use cookies as described in our Privacy Policy. You can change your preferences anytime via Cookie preferences in the footer.
9. Availability and changes
We aim to keep the Service available but don’t guarantee uninterrupted access. We may add, modify, suspend, or discontinue features at any time. Catalogs, prices, and availability change continuously and are provided “as-is.”
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind. We don’t warrant that the Service will be uninterrupted, error-free, secure, that recommendations will be accurate, or that product information will match a brand’s actual offering. Nothing here limits any consumer rights you have under Indian law that cannot be excluded.
11. Limitation of liability
To the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or goodwill.
- Our total aggregate liability for all claims is capped at the higher of (a) the amount you paid us in the twelve months before the claim, or (b) Indian Rupees ₹5,000.
- We are not liable for any act, omission, or breach by a brand whose products are featured on the Service or whose website you reach through an outbound link.
12. Indemnity
You agree to indemnify and hold harmless Ethos & Array from any claims arising out of your use of the Service in breach of these Terms, your content, or your violation of any applicable law or third-party right.
13. Termination
We may suspend or close your account if you breach these Terms, if law requires us to, or if we discontinue the Service. Sections that by their nature should survive (your content licence, IP, disclaimers, liability, indemnity, governing law) will survive termination.
14. Governing law and disputes
These Terms are governed by the laws of India. The courts at New Delhi have exclusive jurisdiction. The parties will first attempt amicable resolution; if unresolved within 30 days, disputes will be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996, with the seat and venue at New Delhi and proceedings in English.
15. Changes
We may update these Terms from time to time. We’ll revise the “Last updated” date and, for material changes, notify you in advance through the Service or by email. Continued use after a change takes effect means you accept the updated Terms.
16. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy form the entire agreement between you and us regarding the Service.
- Severability. If any provision is invalid, the rest continues in force.
- No waiver. Our failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign your rights without our prior written consent.
